1758 - 1830 Abstract of title of John Burnley to property at Havercroft kin Batley

1831 Conveyance, John Burnley to Michael Sheard

This is the lease part of a lease and release, which was the usual form of conveyance of a freehold from 1670 to 1841. Unfortunately the missing part, the release, tells one what is happening [Title Deeds by A A Dibben, end of page 11 and start of page 12. At the end of this page 11 one is told that the phrases bargained and sold, here written as Doth hereby bargain and sell and to the intent, that … may be in actual possession tell one that this is not a genuine lease].

At Havercroft a close formerly called Cuz Croft, now called Housecroft or Tenter Close. To the north is Havercroft Road. To the south premises of John Burnley in occupation of William Blakeley and just beyond part of that is a cloth warehouse, also in occupation of William Blakeley. Under 3 acre.
Witnesses' names difficult to read.

It seems that John Burnley is selling this land to Michael Sheard junior. Henry Blayds holds a mortgage on it and Michael Sheard senior is also involved.

Michael Sheard junior was baptised 29 Apr 1798 son of Michael and Sarah Sheard.

William Blakeley seems to be the one who was baptised 13 Jan 1761. In the original deed, in 1796, of the Batley Subscription Mill [later called the Old Mill] William Blakeley is one of those in the First Part. His brother, John Blakeley, baptised 24 Dec1775, appears to be one of those in the Second Part.

John Burnley, baptised 25 Jul 1779, married their sister, Elizabeth Blakeley on 2 Nov 1801.

The name Tenter Close shows that this field has been used for hanging out cloth to bleach. Detailed measurements and boundaries were given, the release has a plan coloured green, it seems buildings were to be erected on the eastern boundary.

1835 Conveyance, Joseph Senior to the others at the Old Mill

7 May1835

Those of the second part, for themselves and every other of the present proprietors, buy the share of the first part for £203 from the funds of the mill.

Of in and to All that Scribbling [subsequent deeds insert Carding here] and Fulling Mill called the Batley Old Mill with all the Closes, dwelling houses, warehouses, stables, late in the possession of Thomas Dean and company but now of Messrs Hall Sheard and Company, steam engines, boilers, drums, shafts, wheels machines for scribbling and carding of wool and fulling of cloth, machinery, going gear, tackling, watercouses, mines and seams of coal.

Of in and to all and every the Engines, Boilers, Drums, Shafts, Wheels, Machines for scribbling and carding of wool and Fulling of Cloth [subsequent deeds leave out Fulling of Cloth here].

1846 Conveyance, John Ogden Burnley to Samuel Burnley of a share in the Old Mill

(John Ogden Burnley, Sarah Burnley and Sarah Booth are nephew and nieces and next of kin to Hannah Burnley, deceased)

Samuel Burnley buys for £95 one thirty sixth part of all that Scribbling, Carding and Fulling Mill called the Batley Old Mill, formerly in the occupation of Messrs John Scatcherd and Company, but now Messrs Thomas Wilby and Company, with the dwelling houses, warehouses, stables, wright's shop and other buildings belonging to it, built on a close called the Lower Calcroft, the machinery, the dams, weirs and waters, goits, reservoirs, mines, 3 closes called The Chamberlain Ings and other land belonging to the mill.

All parties signed personally this and subsequent deeds

Following an act passed in 1833 Hannah Booth was examined apart from her husband about this deed and she freely consented to it.

1849/50 Conveyance, Joseph Hall to John Burnley of a share in the Old Mill

Dated 20 Sep 1849, but declared executed on 31 Jan 1850 by Thomas Dean on 7 Dec 1858

John Burnley buys for £90 one thirty sixth part of The Batley Old Mill, described as in the 1846 Conveyance, from Joseph Hall, Joseph is acting as an executor of his father's will.

Samuel Burnley lends £150 to John Burnley on security of one thirty sixth part of The Batley Old Mill, described as in the 1846 and 1849/50 Conveyances except that after Messrs Thomas Wilby and Company is now inserted but now in the Occupation of Messrs Michael Sheard and Sons.
